DUI Defense in Indio and the Coachella Valley

A first-time DUI in California is a misdemeanor, but the consequences reach your license, your record, your insurance and your job. Dolan Law Offices has defended DUI charges in Riverside County since 1978.

How California charges a DUI

California prosecutes driving under the influence under Vehicle Code § 23152(a) and (b). Subsection (a) covers driving while under the influence of alcohol. Subsection (b) covers driving with a blood alcohol concentration of .08% or higher. Most drivers are charged under both at once.

A first-time DUI offense in California is a misdemeanor. That word can be misleading. The penalties that follow a misdemeanor DUI conviction are substantial, and two separate proceedings run in parallel: the criminal case in court, and an administrative action by the DMV against your driving privilege.

Penalties for a first-time DUI in California

  • FinesStatutory fines run from $390 to $1,000. Penalty assessments and court fees commonly push the real total to somewhere between $2,000 and $4,000.
  • JailCustody exposure ranges from 48 hours to six months in county jail. It is not always imposed on a first offense, but it is on the table.
  • ProbationTypically three years of informal probation, and in some cases five.
  • DUI education30 hours of classes over three months. If your BAC was 0.20% or higher, that increases to a nine-month, 60-hour program.
  • License suspensionA four-month administrative suspension imposed by the DMV. If you refused chemical testing, one year. The court may impose an additional six-month suspension.
  • Ignition interlock deviceMay be required on your vehicle for six months.
  • Ten-year lookbackA DUI conviction stays on your record for ten years and counts as a prior if you are charged again in that window, which escalates every penalty above.

The DMV hearing runs on its own clock

The DMV action is separate from the criminal case, and it moves fast. You have a limited window after arrest to request an administrative hearing. Missing it can mean the suspension takes effect regardless of what happens in court.

This is the single most common reason people lose a license they might have kept. If you have been arrested for DUI, the time to call an attorney is now, not after the arraignment.

What a defense actually looks at

A DUI case is built out of procedure: the reason for the stop, how field sobriety tests were administered, whether the breath device was calibrated and maintained, how blood was drawn and stored, and whether your rights were observed at every step. Each of those is a place where the prosecution’s case can be challenged.

No attorney can promise you a result, and any attorney who does is telling you something they cannot deliver. What experienced counsel can do is examine every piece of the case, identify what is weak, and argue it.

Common questions

Not automatically. The DMV suspension is administrative and can be challenged at a hearing, but the request must be made within a short window after arrest. Call as soon as possible so the deadline is not missed.

A first-time DUI in California is charged as a misdemeanor. It can be charged as a felony where there is injury to another person, or where there are multiple prior convictions.

A DUI conviction remains on your record for ten years for purposes of counting priors, which means a second offense within that period carries significantly higher penalties.
