Questions people ask first.

General information about California criminal cases. This is not legal advice, and every case turns on its own facts.

Self defense can be a complete justification for your conduct and may result in a dismissal of all charges. It is also legally complex and fact-intensive. Speak with an attorney immediately, and ideally before speaking with law enforcement, because statements made at the scene become the backbone of the prosecution’s case.

You have the right to testify and the right to remain silent. Experienced attorneys often encourage clients not to take the stand, because cross-examination by a prosecutor can damage a defense more than the testimony repairs. A skilled defense frequently challenges the prosecution’s case effectively without the defendant testifying at all. The decision is yours, made with counsel, once the evidence is known.

In violent offense cases the prosecution typically requests custody. A felony probationary sentence can still carry significant jail time, often four to six months. The firm works toward minimizing or eliminating custody, but no attorney can promise you an outcome.

Assault and battery related offenses are often crimes of moral turpitude, which weighs against you in an employer’s character assessment. Once probation has been successfully completed, many of these convictions can be expunged.

It depends on your criminal history and the seriousness of the offense. A minimal record and the absence of serious injury present the strongest case for probation. Be aware that a probationary sentence does not mean no jail time.

Parole applies only after you have served a state prison sentence. Probation applies to all other misdemeanor and felony sentences.
